A Linlithgow businessman narrowly escaped a prison sentence last week after pleading guilty to downloading child porn.

Frank Tomlin, (57), of 29 Portree Crescent, Polmont owns Tomlins Carpets in the town’s high street.

Tomlin claimed in court that he had been suffering stress as a result of having to organise respite care for his elderly parents.

The carpet firm boss was caught with 15 videos on his home computer which he had downloaded over a period of two months last year. These had been stored on the hard drive of the PC in order that they could be viewed at a later date.

The 57-year-old sat in the dock with his head bowed after pleading guilty to one of two charges referred to on the indictment.

It stated that ‘between September 27 and October 14, 2013, he took or permitted to be taken indecent photographs of children.’

Sheriff William Gallacher placed him on the sex offenders register for three years as part of a supervised community payback order.

The sheriff also ordered Tomlin to complete 150 hours unpaid work in the next six months.

The sheriff added: “It is plain there is no way an offence of this type can arise without there being serious harm to other people, particularly children.”
