Bainsford offender threatened police with bottle

Barry Malone (36) appeared at Falkirk Sheriff Court on Thursday having pleaded guilty to behaving in a threatening manner at an address in Suilven Heights, Laurieston, with a threatening phone call to a woman on March 26 last year and brandishing a bottle at police officers on March 27, 2020.

He also admitted breaching his non harassment order on November 11 last year.

Procurator fiscal depute Rachel Wallace said: “The complainer was within her house when she received a phone call from the accused. He said ‘I know where you stay, now you’re dead’. She then contacted police.

“It was 4am when police attended at the accused’s home address and told him to come to the door. He ran to a window and brandished a glass bottle at officers. The accused was asked to open the door, which he did and shouted to officers it was open.

“Police entered the property and found the accused within a bedroom. He was arrested and said ‘I’m telling your sergeant’.”

He swore at officers and told them to “take me up the nick”.

The woman Malone had threatened over the phone later received a Facebook message from him.

“He said ‘looking at these pictures I see how happy I made you’,” said the procurator fiscal depute. “He added ‘why did you not tell me you weren’t happy, we could have fixed things’. She contacted police the following day telling them the accused had breached his non-harassment order.

“The accused came to Falkirk Police Station having been made aware of the inquiry. He was arrested and said he had requested pictures from his ex partner of him with his children.

"He said she had sent him the pictures and added ‘I just sent back one word – thanks. I can’t believe I’ve ended up back here just for saying thank you’.”

Sheriff Christopher Shead placed Malone on a restriction of liberty order to stay in his Flat , Block 6, Symington Drive, Bainsford home between 7pm and 7am for six months and made him subject to a non-harassment order for two years.
