Denny teen avoids imprisonment over violent street assault

The 17-year-olds, who cannot be named for legal reasons, assaulted their victim – then aged 17 – in Town House Street, Denny on October 20, 2019.
The pair pleaded guilty to repeatedly punching the teen on the head, knocking him to the ground and repeatedly punching and kicking him on the body, all to his injury.

Hide AdBoth of the teenagers were due to appear at Falkirk Sheriff Court last Thursday, however, the second culprit, of Cumbernauld, failed to show.
A warrant was granted for his arrest.
The court was told a witness who had stopped for petrol saw the violence unfold following a “disagreement” between a group of youths.
Procurator fiscal depute Sarah Smith said: “As he pulled out the garage forecourt he looked across to Town House Street where he observed four boys talking to each other, two of whom he identified from the garage, and the now accused.
“He thereafter observed one of the accused punching another boy about four or five times to the face. As he punched him, the boy fell to the ground.”

Hide AdThe culprits then continued to boot their victim, who sustained swelling to his eyebrow, head and arm and cuts to his forehead
Defence solicitor Stephen Biggam said the Denny teen had not offended since the incident and has “belatedly started to engage with the right path”.
The teenager was placed under a three-month, 7pm-7am restriction of liberty order as an alternative to custody.
